Citizens for Tree Preservation, Inc. - Press Release
November 3, 2000

DEVELOPERS FAIL TO STOP VOTE

The powerful Northeast Florida Builders Association, Inc. (NEFBA) and three local developers have failed to silence the vote on the proposed Tree Preservation Amendment now confirmed to appear on the ballot next Tuesday, November 7, 2000.

In a 20-page order issued Friday afternoon, November 3, 2000, Circuit Judge Karen K. Cole denied the developers' motion to enjoin the vote, concluding that they had "failed to prove any of the four prerequisites to the issuance of a temporary or preliminary injunction."

Citizens for Tree Preservation, Inc. believes that the people of Duval County must now make their voices heard loud and clear.

For seven months, the citizens worked to place the tree issue on the ballot.

For the past five weeks, the citizens fought to keep the tree issue on the ballot.

Susan Caven, co-founder of Citizens for Tree Preservation, Inc., stated:  "We fought to place and then fought to keep the tree issue on the ballot for the people.  They must now make their voices heard loud and clear."

John Crescimbeni, chairman of Citizens for Tree Preservation, Inc., urged everyone in Duval County to go to the polls Tuesday and vote, stating:  "The proposed Charter amendment is reasonable.  It also allows flexibility for developers in terms of tree replacement.  With the passage of this Charter amendment, the presence of trees in our community will be preserved for future generations."

Lane Welch, volunteer and former president of Greenscape:  "This is democracy at its finest.  We urge all citizens to go to the polls and vote 'yes' on November 7 on the Tree Preservation Amendment."

BACKGROUND:  Northeast Florida Builders Association and three developers filed suit to keep the Tree Preservation Amendment off the ballot.  The Petitioners' Committee for the Tree Preservation Amendment intervened in the lawsuit and argued that the issue should not be removed from the ballot.  Click here to see their memorandum of law in opposition to the developers' motion for a preliminary injunction.
